END-USER LICENSE AGREEMENT (EULA) FOR VONDE PRO APP

IMPORTANT – READ CAREFULLY: This End-User License Agreement (“EULA”) is a legal agreement between you (“Licensee” or “you”) and KMAK Kelet-Magyarországi Adatközpont Kft.  (“Licensor” or “we”) for the Vonde Pro App software application (“App”). By installing, copying, or otherwise using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the App.

  1. Grant of License:

Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the App on a single mobile device for your personal, non-commercial use.

  1. Restrictions:

You shall not:

  • Modify, adapt, or reverse engineer the App, or attempt to derive its source code.
  • Use the App commercially, or sell, distribute, lease, sublicense, rent, lend, or otherwise transfer the App to third parties.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
  • Use the App in any way that violates applicable laws or regulations, infringes upon the intellectual property rights of others, or attempts to circumvent the App’s security measures.
  • Use the App for any illegal activity, including but not limited to, transmitting or storing unlawful material, or engaging in any activity that could damage, disable, overburden, or impair the App or its services.
  1. Ownership:

The App is owned by Licensor and is protected by copyright and other intellectual property laws. Your license confers no title or ownership in the App.

  1. Privacy:

Use of the App is subject to our Privacy Policy, which describes our data collection, processing, and protection practices in detail. By using the App, you consent to the terms detailed in the Privacy Policy. You can find our Privacy Policy at: [Link to Privacy Policy]

  1. Disclaimer of Warranties:

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. Vonde Technology disclaims all warranties, whether express, implied, statutory, or otherwise, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

  1. Limitation of Liability:

To the maximum extent permitted by applicable law, in no event will Vonde Technology be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, or use) arising out of or relating to your use or inability to use the App, even if Vonde Technology has been advised of the possibility of such damages. Vonde Technology’s total liability to you for any and all claims arising out of or relating to this EULA or the App shall be limited to the amount paid by you, if any, for access to the App.

  1. Indemnification:

You agree to indemnify and hold harmless Vonde Technology, its affiliates, employees, directors, and agents from any and all claims, damages, liabilities, losses, or expenses (including reasonable attorneys’ fees) arising out of or relating to your misuse of the App, your violation of this EULA, or your infringement of any intellectual property or other right of any person or entity.

  1. Termination:

This EULA is effective until terminated by you or Licensor. Licensor may terminate this EULA at any time if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the App and destroy all copies, full or partial, of the App.

  1. Governing Law:

This EULA is governed by and construed in accordance with the laws of Hungary. Any dispute arising out of or relating to this EULA shall be subject to the exclusive jurisdiction of the courts located in Budapest, Hungary.

  1. Changes to this EULA:

We reserve the right to update or modify this EULA periodically. Material changes will be communicated to you via app notifications, registered email, or by posting a notice within the App or on our website. Your continued use of the App after any such changes constitutes your acceptance of the revised EULA.

  1. Entire Agreement:

This EULA constitutes the entire agreement between you and Licensor concerning the App and supersedes all prior or contemporaneous communications and proposals, whether oral or written.
